Privacy notice

How Kris Kereluk Personal Real Estate Corp collects, uses and protects personal information across this website and our real estate services in British Columbia.

Real estate clients: When you buy, sell or lease property with us, you will also be asked to review and sign the British Columbia Real Estate Association (BCREA) Privacy Notice and Consent form. That form explains how personal information is handled as part of a real estate transaction, including MLS® System participation.

1. Who we are

This privacy notice applies to Kris Kereluk Personal Real Estate Corp (operating as Kris Kereluk, REALTOR®), licensed under the Real Estate Services Act of British Columbia, and Sutton Group — West Coast Realty, the brokerage where Kris Kereluk is licensed.

References to “we,” “us” or “our” mean Kris Kereluk Personal Real Estate Corp and, where applicable, Sutton Group — West Coast Realty. References to “you” mean website visitors, prospective clients and clients who interact with us.

2. Applicable law

We handle personal information in accordance with British Columbia’s Personal Information Protection Act (PIPA), the Real Estate Services Act and related regulations, and other applicable Canadian privacy laws. Where we participate in the MLS® System and other cooperative real estate services, we also comply with the terms and policies of the relevant real estate boards, the British Columbia Real Estate Association (BCREA) and the Canadian Real Estate Association (CREA).

3. What personal information means

Personal information means information about an identifiable individual. Depending on how you interact with us, this may include your name, contact details, financial information, identification information required by law, property details, transaction history, communications with us, and information you submit through forms on this website or on search.callkris.ca.

4. Information we collect through this website

When you visit callkris.ca, we may collect:

  • Information you provide directly, such as your name, email address, phone number and message content when you submit a contact form, home assessment request, dream home finder form or similar inquiry.
  • Technical and usage information, such as browser type, device type, pages viewed, referring website, approximate location derived from IP address and the date and time of your visit. This information is collected through standard server logs and, where enabled, analytics tools.
  • Communications, including emails, text messages or phone calls you initiate with us.

We do not knowingly collect personal information from children under the age of 13 through this website.

5. Information we collect for real estate services

To help you buy, sell or lease real estate, we collect personal information directly from you through contracts, listing agreements, offers, disclosure statements and related documents, as well as through discussions with your REALTOR®. We may also obtain information from other sources such as land title offices, BC Assessment, financial institutions, mortgage brokers, lawyers or notaries, home inspectors, appraisers, photographers and other service providers involved in your transaction.

6. How we use personal information

We use personal information to:

  • Respond to inquiries submitted through this website or by phone, email or text.
  • Provide real estate services, including listing, marketing, showing, negotiating and completing purchase, sale or lease transactions.
  • Facilitate access to MLS® services, property searches and related tools through search.callkris.ca and affiliated platforms.
  • Coordinate services with third parties involved in a transaction, such as lawyers, lenders, inspectors and stagers.
  • Maintain business records, meet legal and regulatory obligations, and satisfy reporting requirements to bodies such as the BC Financial Services Authority (BCFSA), FINTRAC and REEOIC where applicable.
  • Improve this website, protect against fraud or misuse, and maintain the security of our systems.
  • Send service-related communications. Where permitted and where you have consented, we may also contact you about future real estate services or related offerings. You may opt out of optional marketing communications at any time.

7. When we disclose personal information

We may disclose personal information to:

  • Sutton Group — West Coast Realty and its staff.
  • Real estate boards and associations, other REALTORS®, their brokerages and clients as part of cooperative selling through the MLS® System.
  • Service providers who assist us, such as form processors, website hosts, email providers, photographers, stagers, inspectors, appraisers, lawyers and lenders.
  • Government departments and agencies, including BC Assessment, land title offices, BCFSA, FINTRAC, CREA, BCREA and REEOIC, where required or authorized by law.
  • Members of the public, to the extent listing information is published while a property is actively listed on the MLS® System or otherwise available through public registries.

We do not sell your personal information. We disclose information only as reasonably necessary for the purposes described in this notice or as required by law.

8. Storage outside Canada

Some of our service providers may store or process personal information in Canada or in other countries. When information is stored outside Canada, it may be accessible to foreign governments, courts, law enforcement or regulatory agencies under the laws of that jurisdiction. We take reasonable steps to use reputable providers and to protect information transferred across borders.

9. Cookies and similar technologies

This website may use cookies and similar technologies to remember preferences, understand how visitors use the site and improve performance. You can adjust cookie settings through your browser. Disabling cookies may affect some site functionality.

Embedded content, such as maps or social media links, may be provided by third parties that collect information according to their own privacy policies.

10. How we protect personal information

We use reasonable administrative, technical and physical safeguards designed to protect personal information against unauthorized access, loss, misuse or alteration. No method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

11. Retention

We retain personal information only as long as reasonably necessary to fulfill the purposes for which it was collected, to meet legal, regulatory, contractual and professional obligations, and to resolve disputes or enforce agreements. Real estate transaction records may be retained for longer periods where required by law or professional standards.

12. Your rights

Under PIPA, you may request access to the personal information we hold about you and ask us to correct inaccurate information, subject to limited exceptions. You may also withdraw consent to optional uses of your information, where consent is required, by contacting us. Withdrawal of consent may limit our ability to provide certain services.

If you have signed the BCREA Privacy Notice and Consent form, you may withdraw consent to optional secondary uses by contacting Kris Kereluk or the privacy officer of the applicable real estate board. Contact information for BCREA is available at bcrea.bc.ca or by telephone at 604-683-7702.
